Terms of Service

The terms that govern your access to and use of the Mind app and related services.

1. Acceptance of terms

1.1 Overview

Welcome to Mind, an application (the “App”) provided and operated by Cognitic s.r.o. (“Company,” “we,” or “us”), with its registered office at Pernerova 697/35, Karlín, 186 00 Praha, Czech Republic, company ID (IČO) 09117741 and VAT ID (DIČ) CZ09117741. Cognitic s.r.o. is registered in the Commercial Register maintained by the Municipal Court in Prague under file number C 331203. These Terms of Service (“Terms”) govern your access to and use of the App and related services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1.2 User eligibility

“You” refers to the individual using the App. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1.3 Modifications

We may update these Terms from time to time. Changes will be posted within the App or on this page, and the “Last updated” date will be revised. Continued use after a change means you accept the updated Terms.

2. Privacy policy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle information.

3. Description of the service

Mind offers an AI-guided space for supportive conversations and reflection. Features may include:

  • AI-powered sessions available on demand
  • Voice and text conversations
  • Personalized exercises and reflection prompts
  • Progress, mood, or session tracking
  • Techniques inspired by approaches such as cognitive behavioral therapy and mindfulness

Mind is not a replacement for professional medical advice, diagnosis, treatment, or emergency services.

4. Accounts

You may need to create an account to access certain features. You agree to provide accurate information, protect your login credentials, and notify us of suspected unauthorized use.

5. Subscriptions and payments

Mind may offer free access with limited features and paid subscriptions that unlock additional functionality. Payments are processed through the Apple App Store. Subscriptions renew automatically unless canceled before the renewal date, and refunds are governed by Apple’s policies.

6. Acceptable use

You agree not to:

  • Violate applicable laws or regulations
  • Submit unlawful, harmful, obscene, or infringing content
  • Interfere with the App’s operation or security
  • Attempt unauthorized access or data collection
  • Represent Mind as a substitute for professional medical care

7. Intellectual property

The App and its materials are owned by Cognitic s.r.o. or its licensors and are protected by applicable intellectual property laws.

By submitting content, you grant us a non-exclusive, worldwide license to use and process that content only as needed to provide, secure, and improve the service, subject to our Privacy Policy.

8. Third-party services

The App may link to or rely on third-party services. We are not responsible for their content, availability, or practices.

9. Termination

We may suspend or terminate access when reasonably necessary, including for conduct that violates these Terms or threatens the service or its users.

10. Disclaimers

The App is provided “as is” and “as available,” to the extent permitted by law. We disclaim implied warranties, including merchantability and fitness for a particular purpose.

10.1 Medical disclaimer

  • Mind supports mental wellbeing but is not a licensed medical or healthcare provider.
  • The App does not provide medical advice, diagnosis, or treatment.
  • App content is informational and is not a substitute for advice from a qualified health professional.
  • Always seek qualified professional advice about a medical or mental-health condition.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from use of the App. We are not responsible for decisions made based on information provided by the App.

12. Changes to the App

We may modify, suspend, or discontinue the App or individual features.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Czech Republic. If you are a consumer, this choice does not deprive you of any mandatory protections provided by the law of the country where you live. Any dispute may be brought before a court that has jurisdiction under applicable law.

15. Age restrictions

Users must be at least 13 years old. Users below the age of majority in their jurisdiction must have permission from a parent or legal guardian.

16. Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms form the entire agreement between you and Cognitic s.r.o. concerning the App.

Use of Mind is also subject to Apple’s Standard End User License Agreement.
